Terms of Service

By accessing or using nostr.build (the “Service”), including our website, API, or any connected applications (such as Primal, YakiHonne, Damus, Amethyst, NoStrudel, Coracle, Snort, Iris, X, Facebook, and similar), you agree to be bound by these Terms and our Privacy Policy. Using the Service beyond merely viewing the homepage or these Terms constitutes your affirmative consent and electronic signature, binding you to these Terms. If you do not agree, do not use the Service.

We may update these Terms at any time. Material changes will be reflected by an updated effective date, and your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

You must be at least 18 years of age, or the age of majority in your jurisdiction, to use the Service. The Service is not intended for and may not be used by minors. Accounts are for individual use unless a paid business subscription is explicitly purchased.

Paid plans are billed in advance for the plan term (typically annual) and give you access to the paid features for that term. Prices are quoted in US dollars and payable at checkout in Bitcoin (the Bitcoin amount is determined at the time of payment), by card, or in another supported currency converted at the time of payment.

Renewals and changes. We may change plans, features, and prices. Price changes apply to future terms, not to a term you have already paid for. If you renew at a different tier, any applicable credit is shown and applied at checkout.

Refunds. Except where required by law, payments are non-refundable, and we do not provide refunds or credits for partial terms, unused storage, or features you choose not to use. If you believe you were charged in error, contact us at admin@nostr.build.

Non-payment. If a plan is not renewed, your account may be downgraded to the free tier and your Media may become subject to the deletion process described in these Terms and our Privacy Policy.

“User Content” or “Media” means any images, videos, files, or other materials you upload, submit, or make available through the Service.

“Free Service” means (a) any use of the Service without an active paid plan, including uploads made anonymously or through Nostr clients, apps, or our API, and (b) any copy contributed to the public GIF library, whatever the contributor’s plan. “Public Features” means the parts of the Service that nostr.build itself lists or features for all visitors, such as the public GIF library and public galleries. A direct link to Media in a paid account is not a Public Feature. A copy you contribute to the public GIF library is not Media in a paid account.

You retain ownership of your User Content. By uploading to the Free Service, you grant nostr.build a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to host, store, reproduce, display, distribute, modify, adapt, and otherwise use your User Content as necessary to operate, promote, and improve the Service, including in public galleries for free uploads.

For paid accounts, the license is limited to what is necessary to host, store, and deliver your Media at your direction, and does not include use in public galleries. The licenses above survive only for User Content that remains on the Service: when you delete User Content, or when your account is deleted, we cease the licensed uses of the User Content you deleted, or of the Media stored in your account, going forward and remove it in accordance with our Privacy Policy and the retention periods described there. Copies retained in backups, caches, or content-delivery networks may persist for a limited period until they expire or are overwritten, and we may retain material where required by law or to address violations. Deleting your account does not remove uploads made through the Free Service. A copy you contribute to the public GIF library is separate from your original: until it is published, you can withdraw it; once it is published, it stays in the library even if you delete the original or your account.

You represent and warrant that:

• You own or have all necessary rights, consents, and permissions to upload your User Content and to grant the license above;
• Your User Content does not infringe any third-party rights, including copyright, trademark, privacy, publicity, or other intellectual-property rights; and
• Your User Content complies with these Terms and all applicable laws.

nostr.build is a platform for user-generated content and acts solely as a passive conduit. We do not claim ownership of User Content, do not pre-screen or endorse it, and have no obligation to monitor it. You are solely responsible for your User Content and for all activity under your account.

You agree not to upload, share, or engage with User Content that:

• Is illegal under applicable law, including Child Sexual Abuse Material (CSAM, also known as child pornography); any content exploiting or sexualizing minors (under 18 years of age, including fictional, AI-generated, or simulated depictions); non-consensual intimate imagery (“revenge porn”); or other prohibited material;
• Infringes copyrights, trademarks, or other intellectual-property rights;
• Constitutes hate speech, threats, harassment, defamation, gore, animal or human abuse, or that encourages violence or crime;
• Is otherwise objectionable in our sole discretion; or
• Involves hotlinking to adult content, file-sharing, gambling, torrents, warez, or similar sites; impersonation; or turning the Service into a content-delivery network for external sites.

Minors (every plan): Any sexual or sexually suggestive content that involves a minor, or a person who appears to be a minor, is prohibited everywhere on the Service, whether or not you have a paid plan. This includes: (a) a minor shown in a sexualized pose, outfit, or setting, or framed to focus on intimate parts of the body, including in swimwear or underwear; (b) nudity or partial nudity of a minor presented in a sexual or suggestive way; (c) drawn, animated, 3D-rendered, AI-generated, or otherwise simulated depictions of any of the above, whatever the art style or the claimed age of a character; and (d) text, captions, or audio that sexualize a minor. We judge content by how it appears, not by what the uploader intended, and remove it on detection. We permanently ban the uploader, and we report CSAM as described in “Content Moderation, Removal, and Reporting”.

Pornographic content (Free Service and Public Features): Uploading or sharing Pornographic Content through the Free Service, or to any Public Feature, is prohibited, and we remove it on detection. “Pornographic Content” means any visual or audio material that explicitly depicts sexual acts, including sexual intercourse, oral sex, penetration, or masturbation, whatever the participants’ genders or number. This applies in every medium: photographs, video, audio, and drawn, animated, 3D-rendered, or AI-generated depictions.

Abuse of the Service is strictly prohibited. This includes using the Free Service for business purposes; bots, scripts, excessive uploads, or systematic storage; or any commercial exploitation without a paid account. Violations may result in the consequences described under “Consequences of violations” below.

Paid account holders may use the Service for lawful business purposes and may store and share lawful Pornographic Content depicting only consenting adults, subject to all other prohibitions and these Terms. Pornographic Content is never allowed in Public Features, whatever the uploader’s plan.

We reserve the right to block Tor, VPNs, and specific IP addresses or IP ranges at our sole discretion to protect the Service.

Consequences of violations: If you violate these Terms, we may, in our sole discretion and without notice, remove from the Service all Media uploaded with your Nostr key or through your account, not only the Media that violates these Terms. This includes Media that itself complies with these Terms and Media you uploaded before the violation. We may also terminate your account and block you from the Service. We decide each case individually: we may remove only the violating Media, or we may remove everything. Any CSAM or other serious violation will result in a ban and the removal of all your Media from the Service, and repeated violations may result in the same. We are not obliged to return Media we remove or to let you download it. Where the law requires us to preserve Media, including evidence of a crime such as CSAM, we keep that Media, including backup copies, for as long as the law requires, and we may place your account under a legal hold: while the hold is in place, you cannot change or delete your account or its Media. We may provide Media and related information to law-enforcement authorities where the law requires us to. We keep removed or held Media only for these legal purposes.

We may, but have no obligation to, monitor, scan, or remove User Content at any time in our sole discretion. For Media uploaded through the Free Service, we have the unrestricted right to delete any uploaded content. We will make best efforts to remove illegal content, or content that violates these Terms, once we become aware of it.

Our moderators decide, in their sole discretion, whether content is Pornographic Content, CSAM, sexualizes or exploits a minor, or otherwise violates these Terms. Their decisions are final.

CSAM / Child Pornography Policy: We maintain a zero-tolerance policy. Any detected or reported CSAM will be promptly removed. We will report it to the National Center for Missing & Exploited Children (NCMEC) at missingkids.org and to relevant law-enforcement authorities, and we will fully cooperate with and supply any available information to authorities in any investigation related to CSAM or child pornography.

Paid accounts: Media may be automatically scanned (for example, by Cloudflare’s CSAM Scanning Tool, Microsoft PhotoDNA, or similar tools) solely for CSAM / child-pornography detection. nostr.build employees will not manually view Media in paid accounts except as necessary to confirm an automated detection or to review a report of prohibited content.

If you encounter violating content, report it to admin@nostr.build or by Nostr DM.

Use of nostr.build’s AI Studio, image generation, or editing tools is subject to the terms of service, acceptable-use policy, and privacy policy of the underlying model providers (including Stability AI). Violations may result in account termination, and we report illegal content as required by law.

If we receive a DMCA takedown demand for material you posted that we believe constitutes fair use, we will attempt to notify you if we have your contact information; otherwise, we are under no obligation to notify you regarding the removal. We reserve the right to refuse to remove any material that, in our view, constitutes fair use. If we identify you as a “repeat infringer,” we will block or remove your Media and terminate any accounts you have with us. (If we notify you of a DMCA removal and you respond with a legitimate counter-notice, that will not count toward repeat-infringer status.) We reserve the right to remove any content at any time, whether or not it infringes or violates any of our policies.

Any use of our name, trademarks, or logos must follow our Trademark Use Policy.

To file a DMCA notice, email admin@nostr.build with the required details, including proof of registration where applicable. We reserve the right to disregard invalid notices. See our DMCA compliance page.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you. In that case, our liability is limited to the maximum extent permitted by law.

You agree to defend, indemnify, and hold harmless nostr.build and its affiliates, officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising from:

• Your User Content;
• Your violation of these Terms or any law;
• Your infringement of third-party rights; or
• Your use of the Service.

We may ban any user, delete any Media, or terminate any account for any reason or no reason, at our sole discretion, without notice or liability. This includes violations of these Terms and abuse of the Free Service. Provisions that by their nature should survive termination (including ownership and license terms, disclaimers, limitation of liability, indemnification, arbitration, and governing law) survive.

Agreement to arbitrate. You and nostr.build agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service (a “Dispute”) will be resolved by binding arbitration on an individual basis, rather than in court, except as set out below. This agreement to arbitrate is governed by the Federal Arbitration Act.

Informal resolution first. Before starting an arbitration, you agree to first contact us at admin@nostr.build and give us 30 days to resolve the Dispute informally. Most concerns can be resolved this way.

Arbitration rules and forum. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, as modified by these Terms. The arbitration may be conducted by telephone, video, or written submissions, or in person at a mutually agreed location. The arbitrator may award the same individual relief a court could, and any award may be entered as a judgment in any court of competent jurisdiction.

Class-action and jury waiver. Disputes will be arbitrated only on an individual basis. You and nostr.build waive any right to a jury trial and any right to bring or participate in a class, collective, consolidated, or representative action. The arbitrator may not consolidate more than one person’s claims or preside over any form of representative or class proceeding.

Mass arbitration. If 25 or more similar claims are asserted against nostr.build by or with the assistance of the same or coordinated counsel, the claims will be administered in staged batches to promote efficiency, and the timing of filing fees and arbitrator appointment may be adjusted accordingly.

Exceptions. Either party may bring an individual claim in small-claims court, and either party may seek injunctive or equitable relief in court for actual or threatened infringement or misuse of intellectual property or unauthorized access to the Service. Nothing in these Terms waives any right that cannot be waived under applicable law.

Your 30-day right to opt out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by sending written notice to admin@nostr.build that includes your name, the npub or account associated with your use, and a clear statement that you wish to opt out of arbitration. Opting out has no effect on the rest of these Terms.

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws principles. Subject to the arbitration section above, you agree to the exclusive jurisdiction of the state and federal courts located in Florida for any matters not subject to arbitration. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

These Terms are drafted in English. We may provide translations for your convenience, but the English-language version is the sole authoritative and legally binding version, and it governs in the event of any conflict, inconsistency, or ambiguity between it and any translation.

• These Terms, together with our Privacy Policy, constitute the entire agreement between you and nostr.build regarding the Service and supersede any prior agreements.
• If any provision is held unenforceable, the remainder remains in full force and effect.
• Our failure to enforce any right or provision does not waive it.
• You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
